RTB Warranties

APPLICATION
Techium Limited (Supplier) provides the following Return to Base Warranties (together, RTB Warranties) for the benefit of each Eligible Customer (as defined below):

(a)      Refurbished mobile phones purchased by you either online at www.techium.co.nz or in store will be free from defects in manufacturing and materials under normal use for a period of 12 months after purchase (Refurbished Phones); and

(b)      The mobile device repaired by the Supplier will be free from defects in relation only to the materials used by the Supplier during the relevant repair under normal use of the relevant mobile device for a period of 90 days after that repair (Repairs).

These terms set out the Supplier’s obligations to you where your Refurbished Phones or Repairs are shown to be defective for any reason.  Not all defects are covered by the RTB Warranties and any claim under the RTB Warranties is subject to strict compliance with these terms. 

ELIGIBLE CUSTOMER
To be an eligible customer (Eligible Customer), you must:

  • be a New Zealand resident and accept these terms; and
  • have purchased a Refurbished Phone and you must retain a valid proof of purchase that establishes the date of purchase and verifies the Refurbished Phone remains eligible for the RTB Warranty as it is within the 12 months’ warranty period; and/or
  • have paid for a Repair and you must retain a valid proof of Repair that established the date of Repair and verifies the Repair remains eligible for the RTB Warranty as it is within the 90 days’ warranty period.

MAKING A CLAIM
In order to claim under the RTB Warranties, you must contact us and provide reasonable particulars of the defect claimed and your status as an Eligible Customer.  You must then return the item to the Supplier’s store, where the Supplier will first try and repair your product, if the product is beyond repair, the Supplier will provide a replacement product. If neither of these options are applicable the Supplier will issue a credit or refund. In order to repair, replace or issue a credit or refund for your faulty product, it will need to be returned to the Supplier so that the Supplier can test and confirm that it is faulty. Returns of this nature can be made any time within the warranty period and it is your responsibility to cover any costs of returning the product to the Supplier.

EXCLUSIONS
The RTB Warranties exclude the following:

  • Purchases by persons other than Eligible Customers.
  • Replacement of consumables.
  • Damage caused by accident, neglect, misuse, abuse, improper installation or operation, acts of God (unpreventable event caused by the forces of nature), foreign matter entering the product such as liquid, moisture, insect infestation or dirt. 
  • Damage caused or defects arising from service, maintenance, modification or tampering with the Supplier’s products by anyone other than the Supplier’s authorised representative.
  • Use of products other than for their intended purpose or in a manner contrary to any product manuals or instructions.
  • Any indirect, incidental or consequential loss, cost or damage to an Eligible Customer (including but not limited to loss of revenue, loss of profit, loss of opportunity, loss of goodwill and wasted time).   

If your RTB Warranty is voided for one or more of the reasons described above, the Supplier’s representative will contact you. You may elect either to pay the costs of repair (including the cost of replacement parts), or arrange to pick up your product at your own cost.

GENERAL

  • These terms are in addition to the Supplier’s general terms of trade.
  • The Supplier reserves the right to refuse any claim under these terms should the Supplier determine that you are not a bona fide claimant, have provided us with false or misleading information, or that you otherwise do not meet the criteria set out in these terms. You must respond to the Supplier’s reasonable requests for information so that the Supplier can assess the validity of any claim under the RTB Warranties.
  • The Supplier will not be liable for any failure to fulfil its obligations under these terms to the extent that such non-fulfilment results from circumstances beyond its reasonable control.
  • The Supplier is not be liable for any loss, damage or injury of any nature however caused or sustained by any person in connection with any act or omission of the Supplier under these terms.
  • These terms are governed by New Zealand law. 

 

These Terms are effective from 2 October 2021.
